Public Works Projects include the erection, construction, alteration, painting, repair or improvement of any state structure, building, road or other state improvement of any kind.
This type of contract includes any contract for services in connection with a project other than a project contract and includes, but is not limited to, contracts for architectural, engineering, planning, testing, general studies or feasibility services.
Selection of Firms to provide professional services in connection with a public works project shall be on the basis of demonstrated competence and on the professional qualifications necessary for the satisfactory performance of the services required. Professional Services are not procured on the basis of competitive bids; however, services are to be obtained at fair and reasonable cost.
Agreements for Professional Services are not in force or effect until approved by the CSU Office of General Counsel.
Project Architects
Trustee policy requires all architectural firms seeking commissions on major capital projects to be prequalified. The CSU Office of the Chancellor has established an annual prequalification process to fulfill this requirement. For minor capital projects the Campus may select and appoint any architectural firm from the current year’s system-wide prequalified listing or the Campus may establish its own prequalified list.
Project Engineers
The Campus shall either solicit its own proposals or use its appointed consulting engineer(s).
Minor capital outlay (construction) projects are projects that correct deficiencies, provide new or improved facilities, or provide equipment for new or improved facilities. Section 10108 of the Public Contract Code establishes the maximum cost of a project that may be budgeted as a minor capital outlay project, currently at $752,000. Minor capital outlay (construction) projects may be less formally bid.
Minor capital outlay (construction) projects less than $5,000:
No bidding is required with an estimated cost of $5,000 or less.
Minor capital outlay (construction) projects greater than $5,000 or more:
Bidding is required. Award shall be to the lowest responsible bidder.
The Campus may award a contract that has an estimated value of greater than $5,000, but less than the cost limit identified in Public Contract Code Section 10105, to a certified small business, including a microbusiness, or to a disabled veteran business enterprise, as long as written bids are obtained from two or more certified small businesses, including microbusinesses, or from two or more disabled veteran business enterprises.
Major Capital Outlay Projects are contracts for which the estimated cost exceeds the value of a minor capital outlay project. All bidding provisions of California State University contract law must be followed. Prospective Contractors interested in Major Capital Projects must be prequalified with the Construction Management unit of the CSU Office of the Chancellor.
